[摘要]  随着网络的日益普及，越来越多的人开始接触和使用网络，网络因其具有的无地域限制、承载信息量大以及方便迅捷等突出优势，正在成为人们获取信息、洽谈商务、购买商品和情感交流等活动的重要媒介与手段。网络服务提供者在其中发挥了关键性的作用，离开了他们的技术支持，丰富多样的网络活动根本无法进行。但是，任何事物都具有两面性，互联网自然也不例外。网络具有的虚拟性、无形性等特点也使得它更加容易成为故意或过失侵权行为的“帮凶”，网络服务提供者因此也常常会被迫卷入网络用户与权利人的侵权纠纷之中。
