伴随着现代公共事务日益纷繁复杂,政府不再是公共物品和服务的唯一提供者,传统政府规制理论在实践中的局限性也日益凸显。于是,各国纷纷开始反思原有的公共行政运作模式并着手变革,民营化便是其中的一项重要举措。民营化是将公营的公用事业的所有权或经营权转移到民间,引入真正的市场机制。近几年在我国,相关法律、法规、政策纷纷出台,为公用事业民营化创造了条件;一些地方开放或部分开放公用事业,允许民营企业进入,并取得一定经验。在民营化背景下,公共部门如何选择适当的私人部门参与到公共行政事务之中成为行政法学研究不可回避的重要问题。本文就我国民营化过程中存在的政府规制问题进行了深入探究,并在此基础上提出相关解决对策。
