摘 要
未成年人由于生理、心理、社会阅历等方面的原因,往往被认为是社会的弱势群体,需要社会的帮助。我国刑事司法实践中,对未成年犯罪嫌疑人一直秉持教育、感化、挽救的方针,坚持教育为主、惩罚为辅的原则。《刑事诉讼法》也进一步贯彻这一方针和原则,对未成年犯罪嫌疑人的诉讼程序做出了特别规定,首次引入未成年人犯罪附条件不起诉制度,在对未成年犯罪人做出刑事处罚的时候,适用不同于成年人的刑事诉讼制度,可以更好的保护未成年人的合法权益,有效预防未成年人再次犯罪。

Abstract
Minors because of physiological, psychological and social experience and other reasons, is often considered as the social vulnerable groups, need the help of the society.Criminal judicial practice in our country, the minor criminal suspects have been adhere to the policy of education, persuasion and save, adhere to the principle of education is given priority to, punishment is complementary.New "criminal procedural law" to further implement the guidelines and principles for the proceeding of juvenile criminal suspects made special provisions, for the first time the introduction of minor crime attached conditions not to prosecute system, at the time of the underage criminal to make criminal punishment, apply to criminal lawsuit system is different from adults, can better protect the legitimate rights and interests of minors, effective prevention of minors crime again.
